11/27(金)|医療と司法の協働による人権保障と、その担い手の育成~イギリスのロークリニック・移民法分野の実践から~
健康や暮らしの困難の背景に法的な課題が潜んでいることは少なくありません。こうした現実を踏まえ、健康格差や生活上の困難を人権の問題と捉えて、医療と司法が協働して取り組む枠組みであるヘルス・ジャスティス・パートナーシップ(Health Justice Partnership, HJP)が注目されています。この取組みは、医療や福祉の現場だけでは解決が難しい当事者の法的課題を、早い段階で法的支援へとつなぎ、健康や暮らしへの影響を並行して軽減していくものです。医療と司法が従来の連携にとどまらず協働することで、当事者のウェルビーイングを高め、その人権を統合的に保障しようとしています。こうした取組みは人権擁護そのものであり、その理解を広げるとともに、担い手となる人材を育成していくことも重要となります。
本シンポジウムでは、その両方に資する取組みの一例として、イギリス・エセックス大学エセックスロークリニックの活動を取り上げます。同大学法学部准教授で、エセックスロークリニックの移民法分野にヘルス・ジャスティス・パートナーシップ(HJP)を取り入れているソリシター(イギリス弁護士)のオラインカルイス博士をお招きします。
外国籍市民にとって、在留資格の問題は医療、住居、就労、家族生活など暮らし全体に影響します。医療機関や支援団体に足を運ぶ人の中には、在留に問題を抱えていても、言葉や制度の壁、情報や法的知識の不足、そして経済的な問題など様々な要因で法律家に直接相談することが難しい人も少なくありません。そこで、エセックス大学ロークリニックでは、HJPの考え方を取り入れ、国民保健サービス(National Health Service, NHS)イプスウィッチアウトリーチと連携した実践を重ねています。そこでは学生が実際のケースワークに同席し、医療・福祉職と法律家が協働する支援の現場を間近で学ぶ機会が設けられています。オラインカ ルイス博士からは、こうした連携の仕組みや学生教育のあり方をご紹介いただきます。
日本側からは、早稲田大学法科大学院において「外国人と法」の講義及びクリニックを約20年担当し、学生とともに外国人の在留・難民認定手続をめぐる課題に取り組んできた渡邉彰悟弁護士からその実践を報告いただき、日英の取組みを比較・検討します。さらに、イギリスのHJP実践と日本のリーガルクリニックの取組みを受けて、日本におけるその可能性や新たな展望への示唆について、医療の立場から武田裕子先生(順天堂大学大学院医学研究科医学教育学教授)、司法の立場から猪股正弁護士(日本弁護士連合会貧困問題対策本部・副本部長)をお招きして、それぞれの立場からコメントをいただき、ディスカッションを行います。
本シンポジウムは、共催団体である日本HPHネットワークが主催する第11回J-HPHカンファレンス2026「ヘルス・ジャスティス・パートナーシップ(Health-Justice Partnership)~医療と司法が協働する健康格差への新たな取り組み~」(11月28日・29日開催、別途お申込み・参加費が必要です)の前日に開催いたします。本シンポジウムで移民法分野の具体的な実践に触れたうえで、翌日からのカンファレンスにもご参加いただくことで、HJPへの理解をより立体的に深めていただける機会となります。医療・福祉・法律、そして外国人支援や法曹教育に携わる幅広い皆さまのご参加をお待ちしております。

Protecting Human Rights through Health Justice Partnerships and Training Future Practitioners: Insights from Immigration Law Practice at a UK Law Clinic
Legal problems often lie behind difficulties in people's health and daily lives. In response, the Health Justice Partnership (HJP), a framework in which healthcare and legal professionals work together to address health inequalities and hardship in daily life as human rights issues, has been attracting growing attention. HJP connects people at an early stage with legal support for legal issues that are hard to resolve within healthcare or welfare settings alone, while reducing the impact on their health and lives. By going beyond working alongside each other to truly collaborating, healthcare and law seek to enhance individuals' wellbeing and protect their human rights in an integrated way. Such work is human rights advocacy in itself, and it is important both to broaden understanding of it and to develop the people who will carry it forward.
This symposium features the work of Essex Law Clinic at the University of Essex, UK, as an example that contributes to both. We are pleased to welcome Dr. Olayinka Lewis, Associate Professor of Law at Essex Law School, University of Essex, and a solicitor who incorporates HJP in his practice of immigration law at Essex Law Clinic.
For foreign residents, immigration status affects every aspect of life, including healthcare, housing, employment and family life. Many of those who visit healthcare providers and support organisations have immigration issues, yet find it difficult to consult a lawyer directly because of language and institutional barriers, a lack of information or legal knowledge, financial constraints and other factors. Drawing on the HJP approach, Essex Law Clinic has built up its practice in partnership with the National Health Service (NHS) Ipswich Outreach. Students sit in on real casework and gain first-hand experience of support in which healthcare and welfare professionals work alongside lawyers. Dr. Lewis will introduce how this partnership operates and how students are educated through it.
From Japan, Shogo Watanabe, an attorney who has taught the "Foreigners and the Law" course and clinic at the Graduate School of Law, Waseda University, for about 20 years, working with students on issues concerning residence status and refugee recognition procedures, will report on his practice, and the UK and Japanese approaches will be compared and examined. Building on the UK HJP practice and Japan's legal clinic experience, Yuko Takeda (Professor of Medical Education, Graduate School of Medicine, Juntendo University) from the medical perspective, and Tadashi Inomata (Deputy Head, Headquarters for Anti-Poverty Measures, Japan Federation of Bar Associations) from the legal perspective, will offer comments on the possibilities and new prospects for Japan, followed by a discussion.
This symposium will be held on the day before the 11th J-HPH Conference 2026, "Health-Justice Partnership: New Approaches to Health Inequalities through Collaboration between Healthcare and Law" (28 and 29 November; separate registration and fee required), organised by our co-host, the Japan HPH Network. By engaging with concrete practice in immigration law at this symposium and then joining the conference the following days, participants will have the opportunity to deepen their understanding of HJP from multiple angles. We warmly welcome participants from a wide range of fields, including healthcare, welfare, law, support for foreign residents and legal education.
